Tilt/Trim Safety Start Switch?

I don't know if that is what you call it or not, but it is a highly annoying feature of my Yamaha C-40 and my Yamaha C-90. You cannot start the engine unless it is ALL the way down. It will turn over normally, but will not fire. I want to be able to start it in any position---negotiating shallow-water re-starts require the motor to be trimmed up while starting. Dealer & his tech say they cannot disable this feature or tell me how to do it because of liability concerns. Anyone know which wire to cut? Thanks.

compounder, I get the same results from my OMC 150. I don't think mine is related to any sort of feature preventing a start in an up position. My engine instead seems to over fill the injectors, basically flooding the engine. I know this sounds odd in an injected engine, but if I wait just a few moments it will start in the down position. After the engine has run for a few minutes, it will start in almost a horizontal (or any other) position. Outboards do indeed have a life of their own at times.
